KnowS.com is highly responsible about security and is therefore committed to complying with the legal requirements for data protection.


KnowS.com makes every effort to protect the information you entrust to us from unauthorized access: With the help of a differentiated system of access authorisations and technical protective measures such as SSL encryption, great data security is guaranteed. The input of account or credit card data takes place with KnowS.com only after switching to a particularly secured Internet connection.

 

2. No data transfer

 

The data you entrust us with is safe with us. At KnowS.com there is no sale, exchange or other unauthorized use of personal data and information. 

We ensure that your personal data will not be disclosed to other companies or organizations unless this is necessary to fulfill the purpose for which the data was collected, for example, to fulfill contractual obligations, to respond to their inquiries, for our legitimate business purposes or due to legal requirements. Personal data may be disclosed to or processed by the third parties listed below, if necessary, for the above purposes:
Employees: all employees are bound to secrecy. We keep your personal data secure and strictly adhere to organizational and technical security provisions in accordance with applicable data protection laws.
Affiliated companies: The relationship and handling of personal data is governed by intra-group agreements that provide for compliance with the legal requirements of applicable laws.

Authorities: When required by applicable laws or when ordered to do so by a court.

Internal business infrastructure: We use cyon.ch as a hosting platform to provide our services and Switzerland as a hosting location. In addition, we use other third parties to operate our internal business infrastructure and to provide the Services, for example for backup, storage, payment process, support tool or electronic signatures.

When we share your personal data with such third parties, reasonable precautions are taken to ensure proper and secure data processing in compliance with applicable data protection laws (e.g., EU standard contractual clauses, data processing contracts, confidentiality agreements). We do not allow our third parties to use the personal data we provide to them for their marketing purposes or for purposes other than in connection with the services they provide to us.

 

 

3. Personal data

 

To provide the KnowS.com service, it is necessary that KnowS.com collects, stores, processes and uses the personal data entrusted to it in accordance with the privacy policy. In this context it is, for example, a legitimate interest of KnowS to run our business for the benefit of all our employees and shareholders.

KnowS collects and stores only the personal data provided by the users during registration or automatically collected by cookies. In particular, this concerns the following data: Name, first name, gender, date of birth, e-mail address, company address, telephone number, credit card details and bank account details, possibly proof of identity (e.g. copies of ID, passport or driving licence).

 

The data transmitted by KnowS will be used and processed exclusively for the provision of contractual services. Access to the personal data is restricted to KnowS employees and third parties who enlist KnowS to provide the contractual services (e.g. the external payment provider Stripe, www.stripe.com). The payment service provider may require further information from the user in order to process the payment transaction. This is stated in the privacy policy of the respective payment service provider.

 

In this context, data may be transferred to countries outside Switzerland or the European Economic Area (EEA). Personal data are transferred outside the EEA on the basis of adequacy decisions or other appropriate safeguards, in particular the standard data protection clauses adopted by the European Commission. Please contact us if you wish to request a copy of the specific guarantees for the export of your information.

 

We process and store your personal data for as long as it is necessary for the fulfilment of our contractual and legal obligations or otherwise the purposes pursued with the processing, i.e. for example for the duration of the entire business relationship (from the initiation, processing to the termination of a contract) as well as beyond that in accordance with the legal storage and documentation obligations. It is possible that personal data may be stored for the period in which claims can be asserted against our company and to the extent that we are otherwise legally obliged to do so or justified business interests require it (e.g. for purposes of proof and documentation). As soon as your personal data are no longer required for the above-mentioned purposes, they will be deleted or anonymised as far as possible.

4. Location of our server

 

KnowS stores personal data on servers located in Switzerland or at an affiliated company. Switzerland has been approved by the EU Commission as a country outside the EU and the EEA that ensures sufficient safeguards for the protection of personal data (adequacy decision of the EU Commission pursuant to Art. 45 GDPR).

 

5. Cookies

 

When the user visits the Internet platform, information can be automatically stored on his computer. This happens in the form of so-called "cookies" or a similar file that helps KnowS in various ways, such as getting to know the preferences of visitors and improving the Internet platform. We ask for personal information when you visit our website, use our services, create a user account, make bookings, register for the newsletter, programs, apply for a job or send the CV and when you generally contact us. Cookies are not used to run programs or download viruses to your computer. The main purpose of cookies is rather to provide you with a specially tailored offer and to make the use of the service as time-saving as possible. Most browsers are set by default to accept cookies. 5.1 Subscription to our newsletter

On the KnowS IT GmbH website, users are given the opportunity to subscribe to the newsletter of our company. Which personal data is transmitted to KnowS when ordering the newsletter is determined by the input mask used for this purpose.

KnowS IT GmbH informs its customers and business partners in regular intervals by means of a newsletter about offers of the company. The newsletter of our company can only be received by the person concerned if (1) the person concerned has a valid e-mail address and (2) the person concerned registers to receive the newsletter. For legal reasons, a confirmation e-mail in the double opt-in procedure will be sent to the e-mail address entered for the first time by a person concerned for the purpose of sending the newsletter. The collection of this data is necessary in order to be able to track the (possible) misuse of the e-mail address of a person concerned at a later point in time and therefore serves to legally safeguard KnowS.

The personal data collected in the course of registering for the newsletter will be used exclusively to send our newsletter. Furthermore, subscribers to the newsletter could be informed by e-mail if this is necessary for the operation of the newsletter service or registration in this respect, as might be the case in the event of changes to the newsletter offer or changes to the technical conditions. The personal data collected as part of the newsletter service will not be passed on to third parties. The subscription to our newsletter can be cancelled by the person concerned at any time. The consent to the storage of personal data, which the person concerned has given us for the newsletter dispatch, can be revoked at any time. For the purpose of revoking your consent, you will find a corresponding link in every newsletter. Furthermore, it is possible to unsubscribe from the newsletter at any time directly on the website or to inform us of this in any other way.

5.2 Newsletter-Tracking

The KnowS IT GmbH newsletter contains so-called tracking pixels. A tracking pixel is a thumbnail image embedded in emails sent in HTML format to enable log file recording and analysis. This allows a statistical evaluation of the success or failure of online marketing campaigns to be carried out. Based on the embedded pixel, KnowS IT GmbH can recognize if and when an e-mail was opened by an affected person and which links in the e-mail were accessed by the affected person.

Such personal data collected via the pixel-code contained in the newsletters are stored and evaluated by KnowS in order to optimise the newsletter dispatch and to adapt the content of future newsletters even better to the interests of the person concerned. This personal data will not be passed on to third parties. Affected persons are entitled at any time to revoke the relevant separate declaration of consent submitted via the double opt-in procedure. After a revocation these personal data are deleted. If you unsubscribe from the newsletter, KnowS IT GmbH automatically interprets this as a revocation.

Rights of the data subject

You have the right to information, correction, deletion, the right to restrict data processing and otherwise object to our data processing and to the surrender of certain personal data for the purpose of transfer to another location (so-called data portability) within the framework of the data protection law applicable to you and to the extent provided for therein (such as in the case of the DSGVO).

Please note, however, that we reserve the right to assert the statutory restrictions on our part, for example if we are obliged to store or process certain data, if we have an overriding interest in it (to the extent that we may invoke it) or if we need it for the assertion of claims. 6.1 Privacy policy for the use of Google Analytics

 

On its website KnowS has integrated the component Google Analytics (with anonymization function). Google Analytics is a web analytics service. 9. Adaptation of the data protection declaration

10. Applicable Law and Jurisdiction

This Privacy Policy shall be governed exclusively by Swiss substantive law, without further reference to its conflict of law rules, and excluding all international conventions. Any disputes arising out of or in connection with this Privacy Policy shall be subject to the jurisdiction of the competent courts in the Canton of Zurich, Switzerland.
